I have some of my land rented out that I cannot farm due to working off farm full time. Currently it is under a crop share agreement with a new renter that just took it on this year. He has decided to bale all the straw off every acre this year to sell privately.
My questions is are any bales that he is making and then selling be considered part of the crop share? Or would it only apply to the actual grain that he sells? I never thought about that when we discussed the agreement so not sure how to approach it or if I even should. I know he took it on due to the price straw bales now....and if it was only a few dollars I wouldn't even care, but the amount he will be selling is quite substantial.
I am also considering the nutrient removal that is happening with the loss of the straw that may not be seen for a few years without additional inputs, along with the "good" bacteria etc. that grow and help the soil when decomposing the material. So my concern is not just the extra rent money.
I have to add that we are good friends and work together quite often.
Anyone else had this happen on rental land? or have any experience with doing this while renting someone's land? How did you handle it?

I think it falls under the same crop share agreement as the grain does.
It's removing nutrients and organic matter which will have to be supplemented in the future.

It is part of the crop and he is selling it. I am with captain. I have to pay for all the straw I get, long gone are the days of you can have all the straw you want for free.

Whatever your percentage is, that straw is yours. Lotsa ways to do it. He could drop your share, chop your share, pay you for your share, or you can pay him to bale your share and you can do whatever you want with the bales. Or maybe he's really nice and doesn't charge you for baling?🤷♂️

If you were cash renting the land than the bales are his or hers. Crop share land rent would indicate all revenue from the land is partly yours. I am not a fan of crop share land rent as it leans in the favour of the land owner.

Yes OatKing this is a crop share situation. I will have to find a way to approach this and discuss.
